This Privacy Policy explains how Thomas Jack Foster IV, a sole proprietor doing business as Concours (“AI Design Battle,” “we,” “us,” or “our”) collects, uses, and shares information when you use aidesignbattle.com and related services (the “Service”). By using the Service, you agree to the practices described here.
1. Information We Collect
Account information
When you sign in with Google or GitHub, we receive your name, email address, profile image, and a provider account identifier from that login provider. We use this to create and secure your account.
Content you submit
When you run a design tournament, you provide an app idea or design brief. We store your briefs, the AI-generated designs, screenshots of those designs, tournament results, and any titles or captions generated for them.
Billing information
Paid plans and credit purchases are processed by Stripe. We do not receive or store your full card number. We store a Stripe customer identifier, your subscription tier, and your credit balance and transaction history so we can provide the Service.
Usage and technical data
We record limited product events (for example, which export target you pick or when a tournament is shared) and standard technical data such as IP address, browser type, and timestamps associated with requests. If analytics are enabled, a third-party analytics provider (PostHog) may collect additional usage data via your browser.
2. How We Use Information
- To provide, operate, and maintain the Service and your account.
- To generate designs by sending your briefs to third-party AI providers (see below).
- To process payments, credits, and subscriptions.
- To understand how the Service is used and to improve features and reliability.
- To communicate with you about your account, security, and service changes.
- To detect, prevent, and address fraud, abuse, or technical issues.
- To comply with legal obligations.
3. AI Providers and How Your Briefs Are Processed
To generate designs, we transmit the brief you enter to third-party large-language-model providers, which may include OpenAI, Anthropic, Google, and xAI. Your brief is processed by these providers to return a design. We do not control these providers’ independent data practices; review their policies for details. Do not submit confidential or personal information you would not want shared with these providers in a brief.
We do not use your briefs, designs, or other content to train our own machine-learning models. We are not in the business of model training. Your briefs are sent to the AI providers above solely to generate a design and return it to you. We use these providers under API terms designed so that content submitted through their APIs is not used to train their general-purpose models by default; however, each provider’s practices are governed by its own policies, which you should review.
4. How We Share Information
We do not sell your personal information. We share information only with service providers that help us run the Service (“subprocessors”). The current subprocessors are listed below. This list may change as we add, remove, or replace providers; we will update this Policy and its “Last updated” date when it does, and business customers may request advance notice of material changes as part of a Data Processing Addendum (see below).
- AI providers (OpenAI, Anthropic, Google, xAI) — design generation.
- Stripe — payment and subscription processing.
- Neon — database hosting.
- Vercel — application hosting and screenshot storage.
- Google and GitHub — authentication.
- PostHog — product analytics (if enabled).
We may also disclose information to comply with the law, enforce our agreements, or protect the rights, safety, and security of our users and the Service, and in connection with a sale or transfer of the business or its assets, including a transfer of the Service to a company later formed to operate it.
5. Public and Shared Content
Some features let you share tournament results or designs via a link or social preview. Content you choose to share may become viewable by anyone with the link. Do not include information in a brief that you do not want to be publicly visible.
6. Data Retention
We retain your information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. You may request deletion of your account as described below.
7. Your Choices and Rights
Depending on where you live, you may have rights to access, correct, delete, or export your personal information, or to object to or restrict certain processing. California residents have rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know, delete, and correct personal information and to opt out of its sale or sharing; we do not sell your personal information. To exercise these rights, contact us at support@aidesignbattle.com. You can also stop using the Service and request account deletion at any time.
8. Security
We use reasonable technical and organizational measures to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.
10. International Data Transfers
The Service is operated from California, United States, and we process data in the United States and other countries where our providers operate. If you access the Service from outside the United States, you understand your information will be transferred to, stored, and processed in the United States. Where we transfer personal data of individuals in the European Economic Area, United Kingdom, or Switzerland, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses. By using the Service, you consent to these transfers.
11. Data Processing Addendum
If you use the Service on behalf of an organization and require a Data Processing Addendum (DPA) — for example, to meet obligations under the GDPR, UK GDPR, or CCPA/CPRA as a business — contact support@aidesignbattle.com to request one. Our DPA describes how we process personal data on your behalf, our subprocessors, and the safeguards applied to international transfers, and it supplements this Policy for those customers.
12. Changes to This Policy
We may update this Policy from time to time. Material changes will be reflected by updating the “Last updated” date, and where appropriate we will provide additional notice.
